How we regulate

NFoPP Regulation regulates:

  • Individual members of NAEA, ARLA, ICBA, NAVA and APIP.
  • Companies which fall within the jurisdiction of NAEA, ARLA, ICBA and NAVA.

All individual members are required to adhere to professional standards and follow relevant guidance.

All companies we regulate are required to meet certain company obligations.

We regulate a company (legal entity - see below) when it has a principal (sole trader), partner (partnership or LLP) or director (limited company) who is a member of one of the above divisions and it is active in a business area relevant to that member's division. We call this a PPD (principal, partner or director) firm.

What is a legal entity?

A legal entity is defined as:

  • A person (in the case of a sole trader)
  • A partnership
  • A limited liability partnership (LLP)
  • A private limited company (Ltd)
  • An unlimited company (registered at Companies House)
  • A public limited company (PLC)

Many estate agencies have more than one legal entity within them, for example, different companies might operate at different branches. These might all trade under one customer-facing trading name. One common example of this is franchises.

Divisions and their business areas

We regulate principal, partner and director (PPD) firms within four professional bodies of the property industry. PPD firms of each division are regulated for their activities in the following business areas:

  • Residential Property Sales
  • Residential Property Lettings
  • Residential Property Management
  • Block Management
  • Non-residential Sales
  • Non-residential Lettings
  • Non-residential Property Management
  • Auctions (Including Property and Chattels)
  • Land and New Homes

Association of Residential Letting Agents

  • Residential Property Lettings
